Owens-Brockway Glass Container was given a six-month extension to meet certain building code requirements at its Windsor, Colorado plant, which began operation earlier in 2005. Richard McDonald of Madison, Ohio, representing the contractor that built the bottle manufacturing facility near the Colorado Division of Kodak, told Weld County commissioners that he believed he had met the codes. The Windsor-Severance Fire Protection District, represented by Chief Jerry Ward, told commissioners the district still had a problem with the design of the smoke-heat fan system. Ward said, however, he believed three other issues the fire protection district had were being settled as of 7 November 2005. McDonald said the heat-smoke fan system, which is designed to extract heat and smoke from the building to allow firefighters to get to the source of a fire, is connected to two separate power sources from Poudre Valley REA. In the unlikely event of the failure of these two power sources, a back-up generator would supply power within five seconds. “Basically, we feel we have met the code,” McDonald said. The fire protection district, he said, believes the company has not met the code, resulting in a problem of interpretation. The company has appealed the ruling by the district. McDonald indicated that the time required to fix the problem would not be long if an off-the-shelf solution were available but could be longer if engineering were required. Fire Chief Ward said the appeal should take 30 days.
