A Lyon court has recently cancelled restructuring measures presented on April 9 by glass makers BSN Glasspack and VMC. The measures came on top of a jobs plan announced in 1999 as part of the BSN 2003 plan, bringing the total number of job cuts to 1,250 (out of a workforce of 4,000). In addition, the factory at Givors was earmarked for closure. The court condemned the company for failing to set up a group works council, as had been requested by VMC staff two years ago. Because of the absence of such a structure, the strategic restructuring plan was presented separately last April to the works councils of BSN Glasspack and VMC. Another reason for the court“s decision is that the jobs plan makes no reference to the 35-hour week agreement signed on October 18 and which was to safeguard 70 additional jobs compared with the BSN 2003 plan“s targets. BSN Glasspack and VMC are 44% owned by Danone and 56% by CVC Capital Partners.
