24 September 1998: A US soda ash manufacturing company, American Natural Soda Ash Corporation (ANSAC), has reportedly suffered a setback with the Supreme Court recently, when the court rejected ANSAC“s plea for allowing the company to export its produce for industrial consumption in India. According to a recent press report, bench of Justice S P Bharucha and Justice V N Khare declined to vacate the injunction order passed against ANSAC by the Monopolies and Restrictive Practices Commission (MRTPC), on a complaint by Alkalies Manufacturers Association, a group of six manufacturers which controls 90% of the installed capacity of soda ash in India. In its order, MRTPC ordered on 24 June that ANSAC was a “cartel” causing prejudice to Indian consumers, an unlawful trade practice. ANSAC“s counsel Dushyant K Dave argued that MRTPC“s order was unjustified, as the complainant itself was serving the cause of a “cartel” of three Indian companies. He sought quashing of the MRTPC injunction order.
